The Toxic Substances Control Act (TSCA) & Section 6(h)
- TSCA: U.S. law enacted in 1976 to regulate the introduction of new or existing chemicals.
- Administered by the Environmental Protection Agency (EPA).
- TSCA does not categorize chemicals into toxic and non-toxic but prohibits manufacture or importation of chemicals not on the TSCA Inventory or subject to exemptions.
Section 6(h) - Persistent, Bioaccumulative, and Toxic (PBT) Chemicals
- Section 6(h) added via the Frank R. Lautenberg Chemical Safety for the 21st Century Act in 2016.
- Focuses on PBT chemicals: persist in the environment, bioaccumulate in body tissue, have potential for long-term, harmful effects.
- EPA required to take expedited action to regulate these chemicals, addressing their risks.
