? Free Webinar: What is France’s new anti-waste law (AGEC Law) and what do I need to do?
? Overview:
New French environmental legislation, known as the AGEC law, was implemented on January 1st, 2023. The law requires companies who put products on the French market, and are therefore considered importers or marketers under this legislation, to provide anti-waste data points in a ‘product sheet’.
• Starting from January 1, 2023, it will apply to producers with an annual turnover exceeding 50 million euros and a minimum of 25,000 units of products placed on the French market each year.
• Commencing January 1, 2024, it will extend to producers with an annual turnover surpassing 20 million euros and at least 10,000 units of products placed on the French market annually.
• From January 1, 2025, it will encompass producers with an annual turnover exceeding 10 million euros and a minimum of 10,000 units of products placed on the French market each year
Products that are covered the AGEC law:
- Household Packaging & Papers: This includes packaging for products used by households, printed papers except books, and graphic papers for end users.
- Professional Packaging: Packaging for professional use, except for those used by catering professionals, will be included from January 1, 2025. However, catering packaging will be included from January 1, 2023. There are special rules for agrosupplies sector packaging.
- Building Products: Construction materials for household or professional use are included from January 1, 2022, to ensure free waste take-back and traceability.
- Electronics: All electrical and electronic equipment, for personal or professional use, is covered to collect and recycle components and waste, including rare metals from devices like phones and tablets.
- Batteries & Accumulators: These are included without any specific start date mentioned.
- Hazardous Chemical Products: Contents and containers of chemical products that are hazardous to health and the environment are included, with all their waste covered from January 1, 2021.
- Medicines & Medical Devices: Medicines and some medical devices used for self-treatment or self-testing, including associated electronics, are included.
- Furniture & Textiles: This includes furniture, upholstered seating, sleeping products, and from January 1, 2022, textile decorations.
- Textile Clothing: New textile clothing, shoes, and household linen for individuals are included, with additional textile products from January 1, 2020.
- Toys: Included from January 1, 2022, except those already covered by another category.
- Sporting & Leisure Articles: These are included from January 1, 2022, except those already covered by another category.
- DIY & Garden Items: Included from January 1, 2022, except those already covered by another category.
- Vehicles: Private cars, vans, motorcycles, and similar vehicles are included from January 1, 2022, for recycling.
- Tires: Included from January 1, 2023, with specific conditions for recycling organizations.
- Oils: Mineral, lubricating, or industrial oils are included from January 1, 2022.
- Boats: Pleasure or sports vessels are included without any specific start date mentioned.
- Tobacco Products: Products with plastic filters and related products are included from January 1, 2021, with a requirement for waste recovery.
- Chewing Gum: Non-biodegradable synthetic chewing gum is included from January 1, 2024.
- Sanitary Textiles: Single-use textiles like wipes are included from January 1, 2024.
- Fishing Gear: Gear containing plastic is included from January 1, 2025, with special rules for pre-existing agreements.
- Technical Aids: These are included if they are medical devices, with specific categories and rules to be defined by a decree.
