Malta Packaging EPR Compliance (S.L. 549.43)

What packaging producers must do in Malta

  • If you place more than 100 kg of packaging/packaging material on the market, you must register with ERA and renew your registration every year.
  • If you stop placing packaging on the market, you should deregister.

 

2) 🔁 Choose your compliance route

You can either:

  • Self-comply, or
  • Join an authorised Packaging Waste Recovery Organisation (PRO).

On renewal, producers must report:

  • quantities of packaging placed on the market, and
  • quantities of packaging waste collected, recycled and recovered,
    and all information must be verified by an independent auditor.

 

4) 🎯 Achieve recovery and recycling targets

Targets must be met based on the quantity of packaging placed on the national market (ERA references Regulation 8).

 

🏷️ If you place 100 kg or less

If you place ≤100 kg, ERA guidance indicates you are exempt from producer obligations under S.L. 549.43 except specific provisions, and a declaration form should be completed and submitted.

ERA also notes the registration may be automatically terminated after three calendar years from receipt of that form.

 

🌍 Distance selling: authorised representative

If you are established outside Malta and sell packaging directly to consumers in Malta, ERA guidance indicates you should appoint an authorised representative to fulfil producer obligations locally.
