You are typically in scope if your business places packaging or packaging material on the Maltese market (e.g., manufacturers, importers, brand owners). ERA applies a 100 kg placed-on-market threshold to determine the main registration and producer-obligation route.

🏷️ If you place 100 kg or less

If you place ≤100 kg, ERA guidance indicates you are exempt from producer obligations under S.L. 549.43 except specific provisions, and a declaration form should be completed and submitted.

ERA also notes the registration may be automatically terminated after three calendar years from receipt of that form.

🌍 Distance selling: authorised representative

If you are established outside Malta and sell packaging directly to consumers in Malta, ERA guidance indicates you should appoint an authorised representative to fulfil producer obligations locally.
