The Responsible Person may be:

  • The EU‑based manufacturer or brand owner.
  • An importer or authorized representative established in the EU.
  • A fulfilment service provider located in the EU, if no other operator is established in the Union.

Their duties include maintaining technical documentation, ensuring labeling accuracy, cooperating with market surveillance authorities, and displaying their postal and electronic contact information on the product, packaging, or accompanying documentation.

For online sales, the GPSR requires sellers to provide complete and transparent product information at the time of the offer.

Details must include:

  • The manufacturer’s name, postal address, and electronic contact information.
  • The Responsible Person’s contact details, when applicable.
  • A product identifier such as type, image, serial, or batch number.
  • Any required safety or warning information in the relevant languages.

Platforms must act swiftly to remove listings of dangerous products upon notification.

They must also ensure traders provide correct contact and safety information and maintain communication channels with authorities for rapid response.

Manufacturers must inform authorities immediately of any accident connected with their product that results in death or serious injury.

This requirement is broader than earlier rules, moving beyond mere risk‑based notification.

When a recall is necessary, consumers must be offered free and effective remedies, such as repair, replacement, or refund.

The European Commission will provide a standardized recall notice format to ensure all communications are clear and consistent.

They are also required to impose proportionate and dissuasive penalties for non‑compliance.
