The Law on Poisonous Substances (TSCA), Frank R. Lautenberg Chemical Security, has been amended by the 21st century law, the Environmental Protection Agency (EPA) has to regulate final rules to reduce exposure to certain PBT chemicals. PBT chemicals may be permanent, accumulative and toxic and may have potential risks for exposed population. These chemicals accumulate in the environment over time, so it is important to minimize exposure.

In accordance with TSCA, the EPA issued five final rules to reduce exposure to chemicals, which entered into force on 6 January of 2021. In March 2022, EPA, the prohibition of processing and distribution and a PBT chemical when used in certain products phenol, isopropytyl phosphate (3: 1) (PIP (3: 1)) for the need to keep the compliance with the need to extend the compatibility dates to 31 October 2024. This action was based on detailed information provided during the period of 60 -day public opinion for EPA's October 2021 proposal.

The following five PBT chemicals are under 6 (h) of TSCA:

  • Decabromodiphenyl Ether (Decabde)
  • Phenol, isopropylated phosphate (3: 1) (PIP (3: 1))
  • 2,4,6-Trris (Tert-Butyl) Phenol (2,4,6-TTBP)
  • Hexachlorobutadiene (HCBD)
  • Pentachlorothiophenol (PCTP)

In accordance with the TSCA section 5 (a) (2), EPA may issue important new usage rules (SNURs) for existing chemicals and provide notification of chemicals and mixtures before being used in new ways that may cause concern. SNURs can be used to regulate the production, processing, trade and disposal of chemicals.

Once the EPA decides that the use of a chemical substance is an important new use, TSCA section 5 (a) requires people to send significant new usage notification to EPA at least 90 days before that use.
