The toxic substance control law (TSCA), modified by the Chemical Security Law for the 21st century of Frank R. Lautenberg, requires that the Environmental Protection Agency (EPA) issue final rules to reduce exposure to certain PBT chemicals.These chemicals are persistent, bioacumulative and toxic, and may have potential risks for exposed populations. These chemicals accumulate in the environment over time, so it is important to minimize exposure to them.

To comply with the TSCA, the EPA has issued five final rules that entered into force on January 6, 2021, to reduce exposures to PBT chemicals. In March 2022, the EPA issued another final rule that extended the dates of compliance with processing and distribution prohibitions and the requirement of records associated with one of these PBT chemicals, the phosphate isopropy phenol (3: 1) (pip (3: 1)), when used in certain articles until October 31, 2024.This action was based on the detailed information provided during the 60 -day public comment period for the October 2021 proposal.

The five PBT chemicals under section 6 (h) of the TSCA:

  • Danabromodiphenyl ether (Decabde)
  • ISOPROPILLY PHOSPHAT (3: 1) (PIP (3: 1))
  • 2,4,6-TRIS (T-BUTIL) Phenol (2,4,6-TTBP)
  • Hexaclorobutadieno (HCBD)
  • Pentaclorotiofenol (PCTP)

Under section 5 (a) (2) of the TSCA, the EPA can issue rules of new significant uses (snurs) for existing chemicals to require notice before chemicals and mixtures are used in new ways that can generate concerns.Snurs can be used to regulate the manufacture, processing, distribution in trade and elimination of chemical substances.

Once the EPA determines that the use of a chemical is a new significant use, section 5 (a) of the TSCA requires that people present a new significant use (SNUN) to the EPA at least 90 days before manufacturing (including importation) or processing the chemical substance for that use.
