Toxic Substance Control Act (TSCA) and Article 6(h)

  • TSCA: A US law enacted in 1976 to regulate the introduction of new or existing chemicals.
  • It is managed by the Environmental Protection Agency (EPA).
  • Although TSCA does not classify chemicals as toxic and non-toxic, it prohibits the production or import of chemicals not listed in the TSCA inventory or are subject to exemptions.

Section 6(h) - Degradable, Bioaccumulative, Toxic (PBT) Chemicals

  • Section 6(h) was added by the 2016 Frank R. Lautenberg Chemical Safety for the 21st Century Act.
  • It focuses on PBT chemicals. It can remain in the environment and bioaccumulate in the body tissues, and have long-term, harmful effects.
  • The EPA had to regulate these chemicals and take prompt action to address their risks.
