The toxic Material Control Act (TSCA), as amended by the Frank R. Lautenberg Chemical Safety Act for the 21st century, requires the Environmental Protection Agency (EPA) to issue final regulations to reduce exposure to some local authorities. Local chemicals are permanent, bioacumulative, and toxic, and can risk the exposed population. These chemicals accumulate in the environment all the time, so it is important to reduce exposure to them.
To comply with the TSCA, the EPA issued five final rules effective January 6, 2021, to reduce exposure to local authority. On March 2022, the EPA issued other final rules extending the compliance date for processing and distribution prohibition as well as record storage requirements related to one of these local chemicals, phenol, isopropylated phosphate (3: 1) (PIP (3: 1)), when used in some special items until October 31, 2024.
Here are five Local Authorities under Section 6 (h) of TSCA:
- DECABROMODIPHENYL ETHER (DECABDE)
- Phenol, isopropylated phosphate (3: 1) (pip (3: 1))
- 2,4,6-tris (subject) Phenol (2,4,6-TTBP)
- Hexachlorobutadiene (HCBD)
- Pentachlorothiophenol (PCTP)
Under Section 5 (a) (2) of the TSCA, EPA may issue a new usage regulation (SNUR) for existing chemicals to require notice before chemicals and chemicals are used in new ways that may cause anxiety. Snur can be used to control production, processing, distribution in trade, and chemical removal.
After the EPA determines that the use of a chemical is a significant new use, Section 5 (a) of the TSCA requires individuals to submit a significant new use notice (SNUN) to the EPA at least 90 days before they produce (including importing) or processing chemicals for such use.
