The Toxic Substance Control Act (TSCA) and Section 6 (H)

  • TSCA: 1976 US law enacted to regulate the introduction of new or existing chemicals.
  • Managed by the Environmental Protection Agency (EPA).
  • TSCA does not categorize chemicals in toxic and non-toxic chemicals, but prohibits the production or import of chemicals that are not listed in the TSCA directory or are subject to exceptions.

Section 6 (h) - persistent, bio -accumulable and toxic (PBT) chemicals

  • Section 6 (h) was added in 2016 by the Frank R. Lautenberg Chemical Safety for the 21st Century Act.
  • Concentrates on PBT chemicals: remain in the environment, accumulate in the body tissue and have the potential for long-term, harmful effects.
  • The EPA called for rapid measures to regulate these chemicals and tackle their risks.
