Understanding of compliance with proposition 65 for companies that sell products in California

Proposition 65 requires companies to provide warnings to California residents on significant exposures to chemicals identified by the State as causes of cancer and/or reproductive damage. If you sell products in the state of California, you may be interested in the following three cases:

  1. Your products do not contain a substance from the current list of Proposition 65.
  2. Your products contain one or more substances from the current list of Proposition 65 (https://www.p65warnings.ca.gov/chemicals), but are within the limits of "Safe Harbor" (https://oehha.ca.gov/proposition-65/general-info/current-proposition-65-no-significant-rivels-nslls-maximum) or the expected level of exposure will not constitute a significant risk of cancer or reproductive damage according to OEHHA regulations, available atArticle 7AndArticle 8of Title 27 of the California regulations code.
  3. Your products contain one or more substances from the current list of Proposition 65 (https://www.p65warnings.ca.gov/chemicals) above the limit of "Safe Harbor" and warnings to California residents on significant exposures to chemicals identified by the State as causes of cancer and/or reproductive damage are required.

If the products exceed non -significant risk levels (NSRLS) and the maximum levels of admissible dose (Madls), the products must be labeled with a notice.
An example notice appears as follows:
"Warning: this product can expose to chemicals, including arsenic, which is known to the state of California as a cause of cancer. For more information, visit
www.p65warnings.ca.gov"."
