Understanding Proposal 65 Compliance for Businesses Selling Products in California
Prop 65 requires businesses to provide warnings to California residents about significant exposure to chemicals that have been identified by the state to cause cancer and/or reproductive harm. If you sell products in the state of California, you may be affected in the following three cases:
- Your product does not contain substances from current Proposal 65.
- Your product contains a substance/substance from the current Proposal 65 list (https://www.p65warnings.ca.gov/chemicals), but is within the "safe" limit (https://oehha.ca.gov/proposition-65/general-info/current-proposition-65-no-significant-risk-levels-nsrls-maximum) or the anticipated level of exposure will not pose a significant risk to cancer or reproductive harm in accordance with OEHHA regulations, available in Article 7 and Article 8 of Title 27, California Code of Regulations.
- Your product contains substances/substances from the current Proposal 65 list (https://www.p65warnings.ca.gov/chemicals) above the "safe" limit and warning California residents of significant exposure to chemicals that have been identified by the state to cause cancer and/or reproductive harm is required.
If the product is above the Mean Risk Limits (NSRLs) and Maximum Allowable Dose Limits (MADLs), the product should be labeled with a warning.
An example of a warning looks like this:
"WARNING: This product can expose you to chemicals including arsenic, which the State of California knows can cause cancer. For more information, visit www.P65Warnings.ca.gov."
