Harmonization of classification and chemical labeling in the EU: overview of the CLP regulation and complymarket solutions

The CLP regulation (EC n. 1272/2008) is based on the globally harmonized system of the United Nations (GHS). Its purpose is to guarantee a high level of protection of health and the environment, as well as the free movement of substances, mixtures and articles. The CLP regulation has modified the Directive on dangerous substances (67/548/EEC (DSD)), the Directive on dangerous preparations (1999/45/EC (DPD)), and Regulation (EC) no. 1907/2006 (Reach). From 1 June 2015, the CLP is the only legislation in force in the EU for the classification and labeling of substances and mixtures.

The CLP establishes detailed criteria for the labeling elements such as the Pictograms, the Tape Tishing and the standard indications for risks, prevention, response, conservation and elimination, for each class and category of danger. It also establishes general rules on packaging to ensure the safe supply of dangerous substances and mixtures. In addition to the communication of risks through the labeling requirements, the CLP is also the basis for many legislative provisions on chemical risk management.

The notification obligation pursuant to the CLP requires the producers and importers to send information on the classification and labeling of the substances that put the C&L inventory to the market held by the Echa.

With the addition of a new attachment VIII to the CLP regulation in 2017, the Anti -League centers now have harmonized requirements for the information necessary for the notifications referred to in Article 45. This information is sent to the organs designated in the Member State and are used for the emergency intervention in the event of health risks.
