Harmonization of Chemical Classification and Labeling in the EU: Overview of CLP and ComplyMarket Solutions
The CLP Regulation (EC No. 1272/2008) is based on the United Nations Globally Harmonized System (GHS). Its purpose is to ensure a high level of health and environmental protection as well as the free movement of substances, mixtures and articles. The CLP Regulation amended the Hazardous Substances Directive (67/548/EEC (DSD)), the Dangerous Preparations Directive (1999/45/EC (DPD)), and Regulation (EC) No. 1907/2006 (REACH). Since 1 June 2015, CLP has been the only legislation in force in the EU for the classification and labelling of substances and mixtures.
CLP sets out detailed criteria for labelling elements such as pictograms, hazard statements and standard indications for risks, prevention, response, storage and disposal, for each hazard class and category. It also lays down general rules on packaging to ensure the safe supply of hazardous substances and mixtures. In addition to risk communication via labelling requirements, CLP is also the basis for many legislative provisions on chemical risk management.
The CLP reporting obligation requires manufacturers and importers to submit information on the classification and labelling of substances they place on the market to ECHA's C&L Inventory.
With the addition of a new Annex VIII to CLP in 2017, poison centres now have harmonised requirements for the information needed for Article 45 notifications. This information is sent to the designated bodies in the Member State and is used for emergency intervention in the event of health risks.
