Understanding Proposition 65 Compliance for Businesses Selling Products in California

Prop 65 requires businesses to warn California residents of significant exposure to chemicals that the state has identified causing cancer and/or reproductive damage. If you sell products in the state of California, you may be affected under the following three circumstances:

  1. Your product does not contain any material from the current Recommendation 65.
  2. Your product contains an ingredient/materials from the current Recommendation 65 list (https://www.p65warnings.ca.gov/chemicals), but is within the "safe port" limit (https://oehha.ca.gov/proposition-65/general-info/current-proposition-65-no-significant-risk-levels-nsrls-maximum) or the expected level of exposure will not pose a significant risk of cancer or reproductive damage in accordance with OEHHA regulations, found at Article 7 and Article 8 in Title 27, California Code of Regulations.
  3. Your product contains an ingredient/substance from the current Proposition 65 list (https://www.p65warnings.ca.gov/chemicals) exceeding the "safe harbor" limit and warning California residents of significant exposure to chemicals that have identified by the state causing cancer and/or reproductive damage is required.

If the product exceeds the Significant Risk Levels (NSRLs) and Maximum Allowable Dose Levels (MADLs), the product should be labeled with a warning.

An example warning looks like this:

"WARNING: This product can expose you to chemicals including arsenic, which the State of California knows causes cancer. For more information, visit
www.P65Warnings.ca.gov ."
